Do you need to have a license to be a landlord in Bristol?

Are you considering becoming a landlord in Bristol? If so, there are many things to consider.

Whether you are letting your first property or are an experienced landlord, it is vital to ensure you meet all regulatory requirements. Failure to do so in some cases could lead to prosecution. 

Obtaining a license for the property in question may be necessary, depending on the type of accommodation being let out.

Holding the correct property licence is a legal requirement and demonstrates that the property is suitable for occupation and managed to an acceptable standard.

Failure to hold the appropriate license can also have adverse implications when it comes to a landlord’s eviction rights. 

If a landlord has served a section 21 notice of possession, this will not be valid if they have failed to apply for or obtain the correct property licence on the date that the notice was served. Section 21 notices are used to begin eviction proceedings.

In summary, you must have a licence in Bristol if you’re a private landlord or managing agent of the following types of accommodation:

  • Shared accommodation that’s defined as a House in Multiple Occupation (HMO) anywhere in Bristol in which 5 or more unrelated people live (mandatory licensing scheme)
  • An HMO in which 3 or 4 unrelated people live in the 12 wards of Central Bristol, or in Bedminster, Brislington West or Horfield wards (additional licensing schemes, which came into effect on 6 April, 2022)
  • Privately rented properties in Bedminster and Brislington West wards, including properties let to one or 2 people or families under the selective licensing scheme

If you’re the landlord of a newly rented property you have 28 days to apply from when the property was occupied. 

Failure to license the property could result in prosecution with an unlimited fine or a Civil Penalty Notice (CPN) of up to £30,000.  It could also result in a Rent Repayment Order of up to 12 months’ rent being awarded.

It is important to note that landlords of multiple properties will need a license for each separate property.
